Privacy policy
1. About These Terms
These Terms of Service govern the use of FOSHAN.COM.AU and purchases from the supplier identified in your quotation or invoice, referred to in these terms as “we”, “us” or “our”.
Please read these terms before placing an order. Our Shipping Policy and Refund Policy form part of the purchase terms.
The tile-specific payment, wastage and freight provisions below apply to tile orders. Terms for other products will be confirmed in the relevant quotation.
2. Orders and Agreed Terms
Please provide accurate contact, product, quantity and delivery details and ensure that you are authorised to place the order.
Your order is accepted when we issue written confirmation of the agreed details and receive the required deposit.
Any change to an accepted order requires the agreement of both parties.
A specific term expressly agreed in writing for your order prevails over a conflicting general policy, but cannot remove any non-excludable legal rights.
The terms provided when you place your order apply to that order.
3. Product Selection and Information
Before confirming your order, please check:
-
The product code;
-
Size;
-
Finish;
-
Colour;
-
Quantity; and
-
Intended use.
Screen appearance and natural or handcrafted product characteristics may vary. This does not excuse goods that fail to match an agreed description or sample.
Please tell us before ordering if you require the goods for a particular purpose.
If we discover a material pricing or product error before accepting your order, we will explain the error and seek your agreement to the corrected details. If you do not agree and the order has not been accepted, we will refund any payment received for that order.
4. Tile Quantities and Wastage Allowance
We recommend ordering additional tiles above the measured installation area to allow for cutting, layout and installation wastage:
-
600 × 600 mm tiles: At least 15%;
-
750 × 1500 mm tiles: At least 20%; and
-
Mosaic and handcrafted tiles: At least 10%.
Please confirm the final quantity with your installer, taking the layout and project conditions into account.
These percentages are planning recommendations. They are not a guarantee that the ordered quantity will be sufficient and are not an agreed allowance for defective or missing goods.
5. Prices and Payment
All amounts are in Australian dollars.
Your quotation will set out the total amount payable, including applicable GST and any agreed delivery or loading charges, before payment.
Tile orders require a 70% deposit. The remaining 30% balance must be paid before delivery is arranged from our Sydney warehouse.
We will release goods for delivery or collection after confirming receipt of all amounts due.
Please use the payment details provided in your confirmed order.
6. Delivery and Collection
Tile delivery within 30 km of our Sydney warehouse costs AUD 150 per pallet. Delivery outside this area will be quoted separately.
Buyer collection is subject to a loading fee of AUD 20 per pallet.
Delivery or collection must normally be completed within three days, counted from the day after the container arrives at port, subject to customs clearance and warehouse availability.
We will confirm an appointment and agree on a revised date with you if these conditions or our delivery arrangements prevent timely completion.
Please refer to our Shipping Policy for further information about:
-
Site access;
-
Unloading arrangements;
-
Delivery timing; and
-
Buyer collection.
7. Inspection, Breakage and Installation
Please inspect the packaging when the goods arrive.
If the pallet packaging is visibly damaged:
-
Do not unpack the pallet where it is safe to leave it intact;
-
Photograph and record a video of its condition; and
-
Contact us promptly.
Check the goods before cutting or installation. If a problem becomes apparent, stop using the affected goods and contact us.
Transport damage will be assessed according to the circumstances. No automatic acceptable-breakage percentage excludes a claim.
Cutting, installation, signing for delivery or not retaining the original packaging does not automatically remove your statutory rights.
A remedy may not be available for damage caused solely by misuse or improper handling or installation after supply, rather than by a failure of the goods or our services.
8. Returns, Cancellation and Refunds
After a tile order has been confirmed and the deposit received, we do not offer returns, exchanges or refunds solely because you change your mind.
Contact us promptly if you wish to request a change or cancellation. Any voluntary exception and its conditions must be agreed by both parties.
This provision does not impose a blanket forfeiture of deposits or restrict any legal remedies available to you.
Faulty, damaged, misdescribed, incorrectly supplied or undelivered goods will be handled under our Refund Policy and applicable law.
If we cannot supply the agreed goods, we will discuss the available options with you and provide any refund required by law.
9. Australian Consumer Law and Responsibility
Our goods and services carry consumer guarantees where the Australian Consumer Law applies.
Nothing in these terms excludes or limits any guarantee, remedy, compensation entitlement or liability that cannot lawfully be excluded or limited.
Our Refund Policy explains how to request a remedy.
Delivery estimates, product variation notices and wastage recommendations do not override these rights or any express commitment we have made.
Each party remains responsible for its obligations and for any loss for which it is liable under applicable law.
10. Website Use and Content
You must use this website lawfully. You must not:
-

11. Updates, Applicable Law and Interpretation
Updates to these terms apply prospectively. They do not retrospectively change an accepted order without your agreement.
These terms are governed by the laws of New South Wales and applicable Australian law. This does not limit mandatory legal protections or your right to seek relief in a court or tribunal available under applicable law.
If any provision is unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
The English and Chinese versions are intended to convey the same terms. Please contact us about any discrepancy so that it can be clarified consistently with applicable law.
